This development creates uncertainty about federal guidance and enforcement, but it does not erase the underlying rights of people with disabilities under Section 504 of the Rehabilitation Act, Title II of the Americans with Disabilities Act, or the U.S. Supreme Court\u2019s <em>Olmstead v. L.C.<\/em> decision.<\/p>\n<h2>What remains unchanged<\/h2>\n<p>Public agencies and recipients of federal funding remain responsible for avoiding unnecessary institutionalization and providing services in the most integrated setting appropriate to an individual\u2019s needs. Families and individuals should continue to document service needs, request community-based options, and seek assistance when they experience delays, limits, or denials that may place them at risk of institutionalization.<\/p>\n<h2>Recommended actions for community partners<\/h2>\n<ul>\n<li>Share this update with families, self-advocates, service providers, and other community stakeholders.<\/li>\n<li>Continue helping individuals understand and assert their rights under Section 504, Title II of the ADA, and <em>Olmstead v. L.C.<\/em><\/li>\n<li>Monitor changes in state policies, Medicaid practices, service availability, waiting lists, and other barriers to home- and community-based services.<\/li>\n<li>Document concerns and emerging patterns, particularly when service reductions or delays increase the risk of unnecessary institutionalization.<\/li>\n<li>Review whether your Members of Congress have cosponsored the Latonya Reeves Freedom Act (<a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/9401\" target=\"_blank\" rel=\"noopener\">H.R. 9401<\/a> \/ <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-bill\/4865\" target=\"_blank\" rel=\"noopener\">S. 4865<\/a>) and consider contacting them to express support for protections that strengthen access to community-based services.<\/li>\n<li>Direct families and individuals to trusted legal, advocacy, and disability-rights resources when questions or concerns arise.<\/li>\n<\/ul>\n<h2>FCSN\u2019s commitment<\/h2>\n<p>FCSN is disappointed by the loss of updated federal regulatory language intended to provide clearer direction on community integration. We remain committed to protecting the rights of children, youth, adults, and families with disabilities; supporting access to home- and community-based services; and advocating for policies that promote inclusion, autonomy, and full participation in community life.<\/p>\n<p>We will continue to monitor legal and policy developments and share additional information as it becomes available.
